Terms and conditions

These terms apply to every quotation, order and transport agreement of Kaibisi Transport B.V., unless expressly agreed otherwise in writing.

1. Applicable conditions

Cross-border road transport is subject to the CMR Convention. Domestic road transport in the Netherlands is subject to the AVC conditions (Algemene Vervoercondities 2002, latest version).

For forwarding activities the Dutch Forwarding Conditions (Nederlandse Expeditievoorwaarden) apply, including the limitation of liability contained therein.

A copy of these conditions is provided free of charge on request.

2. Quotations and agreements

Quotations are without obligation and valid for 30 days unless stated otherwise. Rates are based on the information supplied by the customer.

An agreement is formed once we confirm an order in writing or start its execution.

Changes in volume, weight, dimensions, waiting times, route or delivery windows may lead to an adjusted rate.

3. Obligations of the customer

The customer provides complete and correct shipment data, including dangerous goods classification, load securing requirements and temperature instructions.

The customer ensures that loading and unloading locations are accessible and that loading or unloading takes place without unreasonable delay.

Costs caused by incorrect information, refused shipments or waiting times are charged to the customer.

4. Execution and delivery times

Agreed schedules are planned with care. Delays caused by traffic, weather, border controls, strikes or force majeure do not constitute a breach of contract.

We inform the customer as soon as a deviation from the agreed schedule is foreseeable.

5. Liability

Liability for loss of or damage to goods is limited to the amounts set out in the CMR Convention (8.33 SDR per kilogram) or the AVC conditions, whichever applies.

We are not liable for consequential loss, loss of profit, loss of production or immaterial damage.

Cargo insurance beyond the statutory limits is arranged only at the written request of the customer and at their expense.

6. Rates and payment

Invoices are payable within 30 days of the invoice date, unless agreed otherwise.

Fuel, toll and border surcharges may be applied when the underlying costs change materially.

In case of late payment, statutory commercial interest and reasonable collection costs are due.

7. Claims

Visible damage must be noted on the consignment note at delivery. Non-visible damage must be reported in writing within 7 days of delivery.

Claims do not suspend the payment obligation.

8. Applicable law and jurisdiction

Dutch law applies. Disputes are submitted to the competent court in Amsterdam, without prejudice to mandatory provisions of the CMR Convention.
